Terms of Service

1. Introduction

Welcome to Swimrite Leisure. These Terms of Service ("Terms") govern your use of our swimming lesson services and website. By booking or participating in our swimming lessons, you agree to be bound by these Terms.

Established in 1994, Swimrite Leisure operates dedicated teaching pools in Rastrick and Halifax, West Yorkshire, providing high-quality swimming lessons with smaller class sizes and water-based instruction.

2. Services

Swimrite Leisure provides swimming lessons and related services including:

• Individual and group swimming lessons (maximum 6 pupils per instructor, or 7 with assistance)
• Baby classes through to Honours standard swimming instruction
• Adult and children's swimming tuition at all levels
• Water-based instruction for maximum learning benefit
• Assessment days and beginners classes
• Swimming awards and badges program

We operate lessons in blocks of 10 sessions at our dedicated teaching pools in Rastrick and Halifax. All instructors are ASA or STA qualified and CRB checked.

3. Booking and Payment

Lesson Booking

All places must be pre-booked. Lessons are conducted in blocks of 10 sessions. We operate through all school holidays and most public bank holidays. Contact us to book an Assessment day or join available beginners classes.

Payment Terms

• Payment is required at the time of booking or as agreed upon
• We accept various payment methods including bank transfer, cash, and card payments
• Lesson packages must be paid in full before the first lesson
• Prices are subject to change with reasonable notice

4. Cancellation and Refund Policy

Student Cancellations

• Lessons cancelled with 24+ hours notice can be rescheduled or refunded
• Lessons cancelled with less than 24 hours notice are non-refundable
• No-shows will be charged the full lesson fee
• Emergency cancellations will be considered on a case-by-case basis

Instructor Cancellations

If we need to cancel a lesson due to instructor illness, emergency, or pool closure, we will offer a full refund or reschedule at no additional cost.

Holiday Policy

• Pre-booked holidays (giving 7 days notice) will receive a free fun swim
• In adverse weather conditions (e.g., snow) when you cannot travel but we are teaching, you will be offered a free fun swim
• Each free fun swim is for 1 adult and 1 child at allocated times at our Ploughcroft Pool
• If attending Rastrick Pool, please request a fun swim voucher

Weather Conditions

We operate in dedicated indoor teaching pools. Lessons will proceed unless there are exceptional circumstances preventing safe travel or pool operation.

5. Child Protection and Changing Room Policy

Changing Room Policy

• Male parents/guardians are allowed into the BOYS changing room with boys and girls up to the age of 8 years old
• Female parents/guardians are allowed into the GIRLS changing room with girls and boys up to the age of 8 years old
• Children aged 9 years and above must use the changing room appropriate to their gender

Poolside Policy

Parents/guardians are NOT permitted on poolside unless specifically invited by the pool coordinator. This policy ensures the safety and focus of all participants during lessons.

6. Health and Safety

Health Requirements

• Students must be in good health and able to participate in physical activity
• Any medical conditions must be disclosed before lessons begin
• We reserve the right to refuse service if we believe participation poses a health risk
• Students with infectious conditions cannot participate until fully recovered

Safety Rules

• Students must follow all instructor directions and pool safety rules
• Appropriate swimwear is required for all lessons
• No diving unless specifically instructed and supervised
• Pool area must be kept clear of personal belongings during lessons

7. Liability and Insurance

Limitation of Liability

While we take every precaution to ensure safety, swimming lessons involve inherent risks. Swimrite Leisure, its instructors, and affiliated venues are not liable for:

• Accidents or injuries that may occur during lessons
• Loss or damage to personal property
• Illness contracted at swimming facilities
• Injuries resulting from failure to follow safety instructions

Insurance

Swimrite Leisure maintains appropriate public liability insurance. We strongly recommend that participants have their own personal accident and health insurance coverage.

Parental Responsibility

Parents/guardians are responsible for supervising children before and after lessons. Our responsibility begins when the lesson starts and ends when the lesson concludes.

8. Conduct and Behavior

We expect all participants to:

• Treat instructors and other participants with respect
• Follow all facility rules and instructor directions
• Arrive on time and prepared for lessons
• Maintain appropriate behavior in and around the pool

We reserve the right to terminate services for any participant who displays inappropriate behavior, fails to follow safety rules, or disrupts lessons.

9. Privacy and Photography

We may take photographs or videos during lessons for promotional or educational purposes. By participating in our services, you consent to such use unless you specifically opt out in writing.

Your personal information is handled in accordance with our Privacy Policy.

10. Intellectual Property

All lesson materials, teaching methods, and content provided by Swimrite Leisure are our intellectual property and may not be reproduced or distributed without permission.

11. Force Majeure

Swimrite Leisure is not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, facility closures, or public health emergencies.

12. Modification of Terms

We may update these Terms from time to time. Significant changes will be communicated to existing clients, and continued use of our services constitutes acceptance of modified terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
